Italian patent drawings for the UIBM: format, margins and PDF/A

For the UIBM, the Italian Patent and Trademark Office, the drawings of a patent or utility model application go on A4 sheets (29.7 × 21 cm) with black lines and margins of at least 2.5 cm on all four sides; sheets are numbered consecutively and the figures are referred to in the description (Art. 22 of D.M. 33/2010). For online filing, the file has been PDF/A since 1 January 2023.

The difference to remember. The EPO and the PCT allow a 1.5 cm right margin and a 1 cm bottom margin on drawing sheets; Art. 22 of D.M. 33/2010 requires 2.5 cm on every side. A sheet laid out for the EPO does not meet the Italian rule to the letter, while a sheet laid out for the UIBM also meets the EPO and PCT minimum margins.

Who is this guide for?

For applicants and patent attorneys outside Italy who file an Italian patent or utility model application with the UIBM, usually through an Italian representative, for example as a first filing whose priority is later claimed at the EPO or under the PCT. An applicant residing abroad must elect a domicile in Italy (Art. 21(1) D.M. 33/2010). If you validate a European patent in Italy, the Italian translation of the granted text is filed under Art. 56 of the Italian Industrial Property Code: ask your Italian representative which formal requirements apply to its drawings.

The Italian rules below are quoted from Italian sources, which exist only in Italian. An Italian version of this guide is available on inklaim.it.

What does Art. 22 of D.M. 33/2010 require?

Ministerial Decree D.M. 13 January 2010, No. 33 (in Italian) is the implementing regulation of the Italian Industrial Property Code. Its Art. 22 sets the form of the description, abstract, claims and drawings of patent and utility model applications: in 2025 the UIBM received 11,996 patent applications for inventions and 2,073 utility model applications (MIMIT, 2 March 2026, in Italian).

Which sheet and which margins?

Paragraph 1 requires “linee e caratteri a stampa neri su carta bianca forte di formato A4” (black printed lines and characters on strong white A4 paper), with margins of at least 2.5 cm on all four sides, for both drawings and text. The same formats apply to online filing. That leaves a usable area of 16 × 24.7 cm, which must hold all numerals, labels and leading lines.

How high must numbers and letters be?

The 0.21 cm capitals of paragraph 2 apply to the text, not to the drawings. For drawings, the regulation sets no minimum. In practice 0.32 cm is used, the EPO and PCT minimum: good practice, not a rule.

How are sheets and figures numbered?

Under paragraph 3, drawings, which may even be made by hand, are numbered consecutively, and the figure numbers and the numbers of the parts must be referred to in the description. Chamber of Commerce guidance asks for figures to be numbered even when they fit on a single sheet. Paragraph 4 gives 2 months to replace provisional drawings with the final ones.

How do the claims and the text in the drawings fit in?

Art. 21(4) allows references to the figures in the claims only for clarity, and reference numerals do not limit the scope of the claims. Under Chamber of Commerce practice, drawing sheets carry no colors and no wording, except the indications needed to understand them and, where used, the scale (Genoa Chamber of Commerce, 2021, secondary source, in Italian).

D.M. 119/2021 amended Arts. 21 and 25, not Art. 22. Before an important filing, still check the consolidated text on Normattiva (in Italian).

Comparison

UIBM, EPO and PCT: how do the drawing rules differ?

Sheet size and lines are the same. Margins, color, character height and numbering differ.

From UIBM to EPO and PCT: it works

With 2.5 cm on every side, each margin is equal to or larger than the EPO and PCT minimum. If the Italian application will serve as the priority for a European or PCT application, laying out for the UIBM from the start lets you reuse the sheets and adapt only each office's own rules, such as the “1/3” sheet numbering under the PCT.

From EPO to UIBM: the sheet must be redone

A drawing that reaches the edge of the EPO usable area has to be reduced or laid out again. A color drawing accepted by the EPO has to be converted to black and white.

To check with your Italian representative

  • How strictly the UIBM objects, in practice, to a sheet with EPO margins.
  • Any amendments to Art. 22 after 2021.
  • The minimum character height in drawings, which the rule does not set.
  • The guidance of individual Chambers of Commerce, which are secondary sources.

Online filing

How do you prepare the PDF/A for the UIBM portal?

Under UIBM Circular No. 621 of 21 November 2022 (in Italian), since 1 January 2023 the PDF files of national patent and utility model applications filed through the UIBM online portal must be PDF/A (ISO 19005), including follow-up filings and paper filings uploaded by the Chambers of Commerce.

  1. Lay outA4, black lines, nothing inside the 2.5 cm margins.
  2. CheckSheets and figures in sequence, all referred to in the description.
  3. ExportBlack-and-white vector PDF, fonts embedded.
  4. ConvertConvert the file to PDF/A and check that nothing has moved.
  5. SignDigital signature after the PDF/A conversion, not before.

Checklist

Eight checks before filing drawings with the UIBM

If the application will be extended abroad, add the checks of the destination office.

  • White A4 sheets, black lines and characters (Art. 22(1)).
  • No lines, numerals or labels outside the 16 × 24.7 cm area.
  • Sheets and figures numbered consecutively (Art. 22(3) and Chamber of Commerce practice).
  • Every figure and every reference numeral referred to in the description (Art. 22(3)).
  • The same numeral for the same part in all figures: mandatory for the EPO and PCT, good practice in Italy.
  • No color, and no wording beyond the necessary indications and the scale.
  • Numbers and letters at least 0.32 cm high if the application will go to the EPO or the PCT.
  • PDF/A file, digitally signed after conversion (Circular 621).

How Inklaim helps

The same drawing, laid out for the UIBM or for the EPO

Inklaim prepares draft sheets from 3D models, DXF or PDF files, sketches and claims. The UIBM profile sets up the A4 sheet with a 2.5 cm margin on every side.

  • The “Compliance” panel checks, for each figure, usable area, character height, line thickness, labels and sheet numbers.
  • The reference numeral consistency check finds numerals that appear only in the text or only in the figures.
  • Automatic figure numbering keeps sheets and figures in order and updates the references in the text.
  • At export you choose EPO, UIBM, PCT or USPTO and the language of the figure texts: the drawing stays one, and the PDF is vector and black and white.

These are checked drafts, not guaranteed acceptance. PDF/A conversion, digital signature and the final check remain with your firm.

FAQ

Questions about Italian patent drawings

What margins must the drawings of an Italian patent application have?

At least 2.5 cm on all four sides of the A4 sheet (Art. 22(1) D.M. 33/2010). That leaves a usable area of 16 × 24.7 cm.

Can I file sheets laid out for the EPO with the UIBM?

EPO margins do not meet Art. 22 to the letter; how strictly the UIBM objects should be checked with your Italian representative. The safe choice is 2.5 cm on every side, which also works for the EPO and PCT.

Can Italian patent drawings be in color?

No: Art. 22 requires black lines, and Chamber of Commerce guidance excludes colors. The EPO's acceptance of color drawings since 1 October 2025 does not apply to the UIBM.

What file format does UIBM online filing require?

PDF/A (ISO 19005) since 1 January 2023, under UIBM Circular No. 621. The digital signature is applied after the conversion.

What is the minimum character height in UIBM drawings?

D.M. 33/2010 does not set one for drawings. In practice 0.32 cm is used, as for the EPO and PCT.

Do the rules also apply to utility models?

Yes, Art. 22 applies to patents for inventions and to utility models. For designs, Art. 25 refers to the same requirements.

Can a foreign applicant file directly with the UIBM?

Yes, but an applicant residing abroad must elect a domicile in Italy (Art. 21(1) D.M. 33/2010, referring to Art. 197 of the Italian Industrial Property Code). That is why foreign applicants usually file through an Italian representative.
